Defra have published their consultation on Biodiversity Net Gain (BNG) regulations and implementation. It’s open until 5 April 2022.
To help LPAs understand what it covers and how best to respond, PAS (Planning Advisory Service) are running overview events with Defra, Natural England and DLUHC for officers on 8, 10 and 16 February and for members on 15 February. They will also run deep-dive topic-based discussion sessions in March – dates TBC. Further information on BNG for local authorities, including FAQs, is available on the PAS website.
We know from our Annual Conference in November just how much interest there is in this new policy, so this is a great opportunity to understand it in more detail.
Introduced in mid-December 2021 and taking affect through the first two weeks of January 2022, The Town and Country Planning (General Permitted Development etc.) (England) (Amendment) (No. 3) Order 2021 is the latest in a long line of government tweaks to permitted development.

2021 was the busiest year yet for online planning application submissions. The beginning of the year followed on from the extremely high levels seen at the end of 2020, but the end of the year appears to have returned to normality. Have we seen the end of the planning application boom?

Once the new Planning Portal site has launched on 31 January, you will need to change your password, set a security question and update your account information before you can login for the first time.
Follow the steps below to change your current password and update your details:
- Follow this link to change your password: www.planningportal.co.uk/app/first-login
(Please note: this link will not work until the service launches on 31 January). - First the system will need to verify your email address. Enter your email address associated to your Planning Portal account, this will be the email address you currently use to log in.
- Select ‘Send email verification’. A code will be emailed to you. If you cannot find the email, please check your spam/junk folder before contacting us.
- Type the verification code provided in the email into the box on the Planning Portal website, then select ‘Verify code’.
- Select ‘Continue’ on the verification success screen.
- Create a new password and confirm by retyping your new password in the below box.
Password requirements:
– Minimum 8 characters (max 64)
– At least 1 uppercase character
– Lowercase characters
– Numbers (0-9) - Select ‘Create password’.
- Log in using your email address and newly created password.
Next, you will see an edit profile screen. Here you will need to update any information where required, select the account type and set a security question.
Once complete, select ‘Save changes’ and you will be taken to your My applications page of the new service. For help with changing your password please visit our help page.

Temporary measures for marquees to become permanent
The Department for Levelling Up, Housing and Communities (DLUHC) has announced that businesses and hospitality venues will be able to hold markets more often and marquees will be able to be erected without planning permission.
These changes to permitted development rights were first made in 2020 to aid businesses during the Covid-19 pandemic. They are being made permanent following a public consultation.

Two developments approved in Cambridgeshire
Developer CALA Homes has been granted planning for two separate developments – 111 homes will be delivered at Waterbeach and 261 homes will be built at Alconbury Weald in Cambridgeshire.
